Welcome to PK ENTERPRISE. These Terms and Conditions ("Terms") govern your use of our website and the website design and web development services provided by PK ENTERPRISE, a Proprietorship Firm owned by Pawan Kumar, located at Fatehpur, Sikar, Rajasthan, India. By accessing our website or engaging our services, you agree to be bound by these Terms.

1. Services Description

PK ENTERPRISE provides website design, web development, and related digital services including but not limited to:

• Custom website design and development
• Business website creation
• E-commerce website development
• Landing page development
• Domain and hosting setup assistance
• Website maintenance and optimization

The specific scope of services for each project will be defined in a separate project agreement or proposal agreed upon by both parties.

2. Client Responsibilities

As a client, you agree to:

• Provide accurate and complete information required for the project
• Supply content, images, logos, and other materials in a timely manner
• Ensure you have the legal right to use all content and materials provided
• Review and approve deliverables within the agreed timeframe
• Make payments as per the agreed payment schedule
• Provide timely feedback and communication during the project
• Maintain confidentiality of any login credentials or access details shared

3. Project Timeline and Deliverables

Project timelines will be agreed upon before commencement. Timelines are estimates and may be affected by factors including delayed client feedback, content delivery, or scope changes. PK ENTERPRISE will make reasonable efforts to meet agreed deadlines and will communicate any anticipated delays promptly.

4. Payment Terms

Payment terms will be specified in the project proposal or agreement. General payment terms include:

• A project deposit may be required before work begins
• Progress payments may be required at defined project milestones
• Final payment is due upon project completion and before final delivery
• All prices are quoted in Indian Rupees (INR) unless otherwise stated
• Late payments may result in project suspension until payment is received
• Domain, hosting, and third-party service costs are additional unless included in the proposal

We reserve the right to update our pricing. Any price changes will not affect projects already under agreement.

5. Intellectual Property

Upon full payment of all project fees:

• The client receives ownership of the custom design and content created specifically for their project
• PK ENTERPRISE retains the right to use the project in its portfolio unless otherwise agreed in writing
• Third-party components (fonts, stock images, plugins, frameworks) remain subject to their respective licenses
• Pre-existing code, templates, or frameworks used in development remain the property of their respective owners

Until full payment is received, all work product remains the property of PK ENTERPRISE.

6. Revisions and Changes

Each project includes a reasonable number of revisions as specified in the project agreement. Additional revisions beyond the agreed scope may incur extra charges. Significant changes to project scope will require a revised proposal and may affect timeline and pricing.

7. Website Hosting and Domain

Unless explicitly included in the service agreement:

• Domain registration and renewal fees are the client's responsibility
• Web hosting fees are the client's responsibility
• SSL certificates and security services may require additional payment
• PK ENTERPRISE provides setup assistance but is not responsible for third-party service outages

8. Warranty and Support

PK ENTERPRISE warrants that services will be performed in a professional and workmanlike manner. We provide a limited warranty period (typically 30 days from launch) for bug fixes related to our development work. This warranty does not cover:

• Issues caused by client modifications or third-party changes
• Problems arising from hosting or server environment changes
• Content updates or feature additions beyond the original scope
• Third-party service failures or integrations

9. Limitation of Liability

To the maximum extent permitted by law, PK ENTERPRISE shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our services or website. Our total liability for any claim shall not exceed the amount paid by the client for the specific project giving rise to the claim.

We are not responsible for loss of data, business interruption, loss of profits, or any damages resulting from website downtime, security breaches caused by third parties, or force majeure events.

10. Confidentiality

Both parties agree to maintain confidentiality of proprietary business information shared during the course of the project. This obligation survives the termination of the service agreement.

11. Termination

Either party may terminate a project agreement with written notice. Upon termination:

• The client is responsible for payment for all work completed up to the termination date
• Deposits for work not yet commenced may be refunded as per our Refund Policy
• Partial deliverables may be provided upon settlement of outstanding payments
• Access to work-in-progress may be revoked until payment obligations are fulfilled

12. Payment Gateway Integration

When payment gateway integration services are provided, the client is responsible for obtaining necessary merchant accounts, complying with payment processor requirements, and ensuring legal compliance for online transactions. PK ENTERPRISE provides technical integration support but is not responsible for payment processing, transaction disputes, or regulatory compliance related to payment acceptance.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts in Sikar, Rajasthan, India.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting on this page with an updated date. Continued use of our website or services after changes constitutes acceptance of the modified Terms.
